The request came in the form of a petition filed by Samuel de Ingham III in the Los Angeles Superior Court Tuesday evening.
Jimmy Spears has been the guardian of her person and property since 2008. Montgomery has served as the singer’s temporary guardian since the elder Spears stepped down from the job due to health problems in September 2019.
In the filing, obtained by CNN, Ingham cites an order filed on October 10, 2014 that Britney Spears had “an inability to consent to any form of medical treatment” as the reason for Montgomery to take full custody.
CNN reached out to Ingham on Wednesday and asked him to explain why the singer was unable to make medical decisions. Angham stated that he “cannot comment on a pending case.”
“No comment,” Jimmy Spears’s lawyer, Vivien Leigh Turin, said.
The deposit requires, in addition to seeing Spears’ medical decisions, that Montgomery be able to “restrict and restrict visitors by any means,” except for meeting with Angham. It also demands that Montgomery be able to “retain carers” and “security guards” for Spears.
The singer’s father was first appointed to court as a custodian of his daughter’s property, along with attorney Andrew Walt, in 2008, after a series of personal cases that were brought publicly to the singer. During most of that time, he also oversaw her health and medical decisions. Jimmy Spears became the sole custodian of the singer’s $ 60 million estate in 2019, after Wallet resigned.
Ingham first applied to officially remove Jimmy Spears from the supervisor position last August. In November, a judge ruled that Spears would remain as assistant custodian of the estate, but appointed the Bessemer Trust to act as associate custodian.
CNN contacted the Bessemer Trust for comment.
He said at the time, “I love my daughter and miss her so much.” “When a family member needs special care and protection, families need to intensify efforts, as they have done for the last 12 years, to protect, protect and continue her love unconditionally. my family “.
“[Jamie] “I would love nothing more than seeing Britney need no tutelage,” Turin said. If she wants to end her guardianship, she can petition to end it. “
According to court documents obtained by CNN in December, Angham said Britney would not perform her role again as long as her father kept control of her fortune.
Although Britney has not publicly commented on the ongoing conservation battle, she has responded to recent speculation about whether she is planning to perform again.
The next court session on guardianship is scheduled for April 27.
